Terms of Use

These terms cover how haulers and providers use TowLynk.

1. Who we are

TowLynk is a technology platform operated by Pettaway LLC. These Terms of Use are an agreement between you and Pettaway LLC and apply whenever you use the TowLynk app or website. If you do not agree, do not use TowLynk.

1a. Key terms

“TowLynk™” is the technology marketplace operated by Pettaway LLC that helps people and businesses needing trailer-related roadside, repair, maintenance and related services (“Haulers”) connect with independent service providers (“Providers”). A “Service Request” is a request submitted through TowLynk for services from a Provider. A “Provider Quote” is the amount proposed by the Provider for the requested services. TowLynk does not itself perform towing, roadside assistance, repair, maintenance, transportation, mechanical work or other services offered by Providers, and Providers are not employees, agents, partners, franchisees, joint venturers or representatives of TowLynk.

2. What TowLynk is — and is not

TowLynk is a marketplace. We provide technology that connects trailer owners and haulers who need roadside assistance with independent roadside service providers, plus matching, quoting, communication and job-tracking tools. TowLynk does not perform towing, roadside repair, vehicle or RV repair, mechanical work, transportation, recovery or any other roadside service. TowLynk is not a towing company, repair shop, motor carrier, roadside assistance club, insurer or emergency service.

3. Providers are independent third parties

Providers are independent businesses or individuals. They are not employees, agents, partners or joint venturers of TowLynk or Pettaway LLC. Each provider decides whether to quote, what to charge, how to perform the work, and is solely responsible for the services it performs, its personnel, vehicles, equipment, licensing, permits, insurance and compliance with law.

4. No guarantee of service or outcome

TowLynk does not guarantee that any provider will see, quote on, accept or complete your request; that a provider will arrive within any estimated or particular timeframe; that a quote will be at any particular price; that a trailer, vehicle or issue will be repaired, recovered or resolved; or that any provider will be available in your area at any given time. Distances, drive times and arrival estimates shown in the app are estimates generated from mapping data and provider-reported information, and can be wrong.

5. Provider review — what TowLynk actually does

Before a provider account is approved, TowLynk may review the onboarding information and documents the provider submits, including license or business-registration documentation and insurance documentation, and a TowLynk admin reviews those submitted documents. Providers must also affirm an attestation that their information is true and current. That is the extent of TowLynk's review. TowLynk does not perform criminal background checks. TowLynk does not perform driving-record or motor-vehicle-record checks. TowLynk does not independently verify documents with issuing agencies, licensing boards or insurance carriers. TowLynk does not confirm that a license or insurance policy remains valid, in force or unexpired after review. TowLynk does not inspect provider vehicles, tools or equipment. TowLynk does not certify, endorse, employ, supervise or guarantee any provider or the work they perform. TowLynk may re-review a provider account or its documents at any time. “TowLynk Approved Provider” and similar labels mean only that the provider completed this document-review process — they are not a certification, endorsement, guarantee, warranty, background check, criminal-history screening, motor-vehicle-record check, safety guarantee or workmanship guarantee.

6. Emergencies

TowLynk is not an emergency service and cannot dispatch police, fire or medical responders. If there is a medical emergency, fire, crime or immediate danger, call 911 or your local emergency number.

7. Your account

You must be at least 18 and legally able to enter into contracts. You agree to provide accurate account information, keep it current, keep your credentials secure, and be responsible for activity under your account. Do not use TowLynk on behalf of someone else without their authority, and do not create accounts to evade a removal or suspension.

8. Requests, quotes and the approved amount

Haulers describe the help they need; providers may respond with quotes. The provider sets its own price. When you approve a quote you are agreeing to that price and scope with that provider — TowLynk is not the service provider and does not set, review or endorse provider pricing. The amount you approve is the approved amount for that job.

9. Payments — current state

TowLynk does not currently process service payments through the platform. Until in-app payments are enabled, Haulers and Providers are responsible for arranging payment directly with each other. TowLynk does not currently authorize, hold, capture, transfer, refund or otherwise control those service-payment funds. Any direct payment arrangement is between the Hauler and the Provider. TowLynk will notify users before in-app payment processing becomes available and any applicable payment terms take effect. The TowLynk Payments, Cancellations & Refunds Policy is part of these Terms and applies whenever TowLynk payment functionality applies to a Service Request.

10. Planned TowLynk payment model and platform fee

PLANNED — NOT YET ACTIVE. When TowLynk enables in-app payments, payment functionality is planned to work as follows. The Provider sets the service price. The Hauler affirmatively approves that price before any payment step proceeds. No separate TowLynk platform fee is added on top of the approved service price to the Hauler. TowLynk retains 15% of the approved service price as its platform fee, and the Provider receives 85%, subject to lawful adjustments, reversals and refunds. TowLynk currently intends to absorb ordinary payment-processing cost from its 15% rather than deducting it from the Provider's 85%. A Provider price increase would require new affirmative Hauler approval before an increased amount could be charged. Payment authorization is planned to occur before operational dispatch, and capture after completion under the implemented payment workflow. Payment processing will use a third-party payment processor, and payment processing terms may also be subject to that processor's terms. None of this payment functionality is active today.

11. Price changes and additional work

The amount a hauler approves is the approved amount. A provider may not charge an increased amount without the hauler approving the revised amount. If the scope of work changes, the provider must communicate the change before performing additional work that would increase the approved price, and the hauler explicitly approves or rejects the revised amount. A rejected change leaves the originally approved amount in place; work beyond the approved scope is at the provider's discretion and risk.

12. Cancellations and refunds

PLANNED — NOT YET ACTIVE for TowLynk-processed payments. A hauler may cancel a request before a provider accepts it. Once TowLynk processes payments, cancellation and refund eligibility and amount may depend on the status of the job, whether the provider began traveling to the service location, expenses the provider reasonably incurred, such as materials required for the accepted service, whether services were performed and how much work was completed, provider conduct, hauler conduct, duplicate or erroneous charges, other relevant circumstances. TowLynk may provide a full refund, a partial refund or no refund as reasonably appropriate under the applicable policy and the facts. TowLynk has not adopted an automatic cancellation fee. A refund cannot exceed the amount actually paid through TowLynk, and processing and settlement timing may depend on the payment processor and the relevant financial institution. If provider funds associated with a refunded or disputed transaction have already been transferred, TowLynk may recover, reverse, offset or otherwise adjust the applicable provider amount as permitted by the Provider Agreement and the payment system. Nothing in this policy limits consumer rights that cannot be waived under applicable law. Because TowLynk does not currently process service payments, refunds or payment reversals for payments made directly between a Hauler and Provider generally must be resolved between those parties. TowLynk may assist with platform records or account review but does not control funds it did not process.

12a. Payment disputes and chargebacks

Haulers should first use TowLynk's support process when there is a service or payment issue. Nothing here waives rights a consumer may have under applicable law or card-network rules. Users must cooperate reasonably with legitimate payment investigations, and providers must cooperate with TowLynk when information is needed to respond to a payment dispute or chargeback. If and when TowLynk processes payments, TowLynk may recover from a provider amounts resulting from provider conduct — including failure to perform accepted services, fraud, material misrepresentation, unauthorized charges, charging for unapproved additional work, or other provider conduct that directly caused the payment loss. Providers do not automatically bear every payment dispute regardless of cause. Because TowLynk does not currently process service payments, TowLynk cannot resolve a chargeback or payment reversal for a direct payment between a Hauler and a Provider.

12b. Taxes

Applicable taxes may be added, collected, reported, withheld or remitted where required by law. Providers remain responsible for taxes applicable to their independent businesses, except where TowLynk or its payment processor is legally required to collect, report, withhold or remit an amount.

13. Who is responsible for what

TowLynk is responsible for the platform it provides: the app and website, account and request handling, matching and notification tools, masked calling, and the accuracy of what TowLynk itself states about its own service. Providers are responsible for the roadside services they perform, their pricing, scope, timing, workmanship, personnel, vehicles, equipment, licensing, permits, insurance, taxes and compliance with law, and for any damage or injury arising from their work. Haulers are responsible for accurate request and vehicle information, safe access to the site, lawful authority over the vehicle or trailer, being reachable, paying approved amounts, and their own safety decisions at a roadside location. Other third parties — mapping, telephony and payment providers — are responsible for their own services under their own terms. TowLynk does not guarantee provider availability, arrival time, provider qualifications beyond the document review described in section 5, successful completion of a service, any repair result, the safety of any roadside location, or resolution of an emergency. None of this is intended to disclaim responsibility for TowLynk's own conduct or any obligation that cannot lawfully be disclaimed.

14. Communication and masked calling

Calls placed in TowLynk are connected through a TowLynk phone number. Your personal number is not shared with the other party, and theirs is not shared with you. Call records (time, duration and the parties involved) are kept for support, safety and abuse investigations. Standard carrier rates may apply.

15. Location

The location you set for a request is shared with providers matched to that request so they can quote and find you. You can see an assigned provider's live progress while a job is active. While you are online, TowLynk uses your device location to determine which nearby requests you are eligible for and, on an active job, to show your live progress to that hauler. Turning off online status stops eligibility matching from your live location. Location sharing through TowLynk is described in the Privacy Policy. You can stop sharing by turning off location permission in your device settings, but TowLynk may not be able to match requests or show job progress without it.

16. Ratings, reviews and provider quality review

Haulers may rate and review a completed job once. Reviews should be truthful, based on first-hand experience, and free of personal contact details, threats, harassment, discriminatory content and unlawful content. TowLynk may remove reviews that violate these rules and uses ratings as part of provider quality review. A provider account is automatically locked for quality review when it receives a third qualifying 3-star rating from a completed, assigned TowLynk job. The lock is an automatic quality-review trigger — it is not a finding that the provider was negligent, provided poor service, or committed misconduct or any other wrongdoing. While the lock is open the account stays visible to its owner but cannot receive new TowLynk opportunities: it cannot go online, receive requests, quote or accept new jobs. A TowLynk administrator reviews the account, its recent reviews and relevant history, and may restore, suspend, reject or otherwise manage the account in accordance with the Provider Agreement.

17. Acceptable use

Do not use TowLynk to do anything unlawful, fraudulent, deceptive, harassing, threatening, discriminatory or unsafe; to misrepresent your identity, business, licensing or insurance; to solicit parties off-platform in order to evade TowLynk's safety, privacy, payment or quality tools; to misuse the masked calling feature; to scrape, reverse engineer, overload or interfere with the service; or to collect other users' personal information for purposes other than the job you are working on together. We may investigate reports and may review, restrict, lock, suspend or remove accounts.

18. Content you submit

You keep ownership of the content you submit (request details, photos, business information, reviews). You grant TowLynk a non-exclusive, worldwide, royalty-free license to host, store, reproduce and display that content as needed to operate, secure, support and improve TowLynk. You are responsible for having the rights to what you submit.

19. Service availability and changes to these Terms

TowLynk is provided on an as-available basis, is a new product, and may contain errors or interruptions. We may change, suspend or discontinue features. TowLynk may update these Terms from time to time, and the updated version and its effective date will be posted in the app. Where changes are material, or where required by applicable law, TowLynk may provide additional notice and may require your affirmative acceptance before you continue using the affected functionality. Non-material changes may take effect when posted, as permitted by applicable law.

20. Disclaimers

To the fullest extent permitted by applicable law, TowLynk and Pettaway LLC provide the platform “as is” and disclaim warranties of merchantability, fitness for a particular purpose and non-infringement with respect to the platform itself, and make no warranty regarding the acts, omissions, work, pricing, conduct, credentials or insurance of any provider or hauler. Nothing in these terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited, and some jurisdictions do not allow certain exclusions — in that case the exclusion applies only to the extent permitted.

21. Limitation of liability

To the maximum extent permitted by law, Pettaway LLC and TowLynk are not liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost revenue, loss of use, loss of data, business interruption or the cost of substitute services, arising from or related to the platform or to services obtained from independent Providers. TowLynk is not responsible for the acts or omissions of Providers or Haulers; the quality or outcome of Provider services; roadside conditions; vehicle, trailer or property damage caused by an independent Provider or user; delays; Provider availability; inaccurate user-supplied information; GPS, location, ETA or navigation inaccuracies; third-party service outages; or direct payment arrangements TowLynk did not process. To the maximum extent permitted by law, TowLynk's aggregate liability arising out of or relating to the platform will not exceed the greater of (a) amounts actually paid to TowLynk by the claimant through the platform during the six months preceding the event giving rise to the claim, or (b) $100. This limitation does not apply where it is prohibited by applicable law. Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

22. Indemnification

Each user indemnifies TowLynk for claims arising from that user's own role. A Hauler will indemnify and hold harmless Pettaway LLC and TowLynk from third-party claims arising from the Hauler's unlawful use of the platform, material breach of these Terms, false or misleading information the Hauler supplies, the Hauler's own negligent or intentional misconduct, and vehicle or property conditions or instructions attributable to the Hauler, in each case to the extent legally appropriate. A Provider will indemnify and hold harmless Pettaway LLC and TowLynk from third-party claims arising from the Provider's services, the Provider's personnel or subcontractors, the Provider's unlawful conduct, material breach of these Terms or the Provider Agreement, licensing, permit or insurance failures for which the Provider is responsible, and the Provider's negligent or intentional acts or omissions. TowLynk will provide reasonable notice of an indemnified claim where practicable. No indemnification obligation applies to the extent it is prohibited by applicable law, or to the extent the claim results from TowLynk's own conduct for which indemnification cannot lawfully be shifted.

23. Provider classification

Providers are independent third-party businesses or independent contractors. Nothing in these Terms creates an employment, partnership, joint-venture, franchise, agency or fiduciary relationship between TowLynk or Pettaway LLC and any Provider. Providers control whether to accept opportunities, the services they offer, their availability, their lawful methods, equipment and personnel, and their quoted prices, subject to platform rules and applicable law. TowLynk does not direct the manner and means by which Provider services are physically performed. Providers are responsible for their personnel, taxes, licenses, permits, insurance, equipment and legal compliance applicable to their business. Platform safety and quality rules exist to protect users and do not create an employment or agency relationship.

24. Dispute resolution and governing law

If you have a dispute with TowLynk, the parties should first attempt good-faith informal resolution by contacting support@towlynk.app. Describe the issue and the resolution you are requesting, and TowLynk may request reasonable information needed to investigate. Nothing here prevents you from contacting regulators, law enforcement or emergency services, or from exercising rights that cannot be waived. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except to the extent federal law or another applicable law controls. Subject to applicable law and any non-waivable right to bring a claim elsewhere, judicial proceedings involving Pettaway LLC or TowLynk shall be brought in a court of competent jurisdiction in Georgia. A dispute solely between a Hauler and an independent Provider does not make TowLynk a party to that dispute.

25. Disputes between haulers and providers

Disagreements about service quality, scope, pricing, damage or payment are primarily between the hauler and the provider. TowLynk may, but is not obligated to, review reports, request information and take account action such as a quality lock, suspension or removal. TowLynk is not a party to those service agreements and does not adjudicate damages.

26. Termination

You may stop using TowLynk at any time and may request account deletion at support@towlynk.app. We may suspend or terminate access for violations of these terms, safety concerns, suspected fraud or as required by law. Some records, such as job, call, payment and review records, may be retained as described in the Privacy Policy.
